Affirming.

J. S. Owsley and T. J. Hill, Jr., were candidates for the Democratic nomination for county attorney of Lincoln county in the primary election held August 1, 1925. Hill received a majority of the votes, and was awarded the certificate of nomination. Owsley contested the nomination, and the trial court dismissed his contest. He has appealed. Owsley began his contest in proper time by serving upon Hill a very voluminous notice setting out five grounds of contest, one of which he admits in his brief to be without merit, and another he failed to…
