*1043In an action to recover damages for personal injuries, etc., the defendant appeals from an order of the Supreme Court, Orange County (McGuirk, J.), dated November 2, 2006, which denied its motion pursuant to CPLR 3211 to dismiss the complaint for failure to comply with General Municipal Law §§ 50-e and 50-h.

Ordered that the order is affirmed, with costs.
