Harrison, J.:

Ben. Gerson sued William E. Slemons before a Justice of the Peace on the following due bill:

“Memphis, Tens., March 18th, 1878.
“Due Ben. Gerson one hundred dollars, for money advanced

W. E. Slemons.”

Slemons filed the following set off:
