Appeal from an order of the Court of Claims (Lyons, J.), entered April 20, 1992, which, upon reargument, adhered to its prior deci*872sion granting claimant’s motion pursuant to Court of Claims Act § 10 (6) for permission to file a late notice of claim.

On April 12, 1987, the Department of Motor Vehicles (hereinafter DMV) issued a certificate of title naming A. W. Trucking as the owner of a 1986 Peterbilt tractor-trailer.
