On this date, the Court considered Defendants AT & T, Inc.’s and BellSouth Corporation’s Motion for Summary Judgment (docket no. 79), Plaintiffs’ Motion for Partial Summary Judgment (docket no. 81), and the responses and replies thereto. The issue presented in both motions is whether a benefit known as “telephone concession” provided to BellSouth retirees living outside of Defendants’ service area is an ERISA pension plan.
