This is an appeal by appellant railway company from a judgment of the district court of Grayson county in fayor of appellee, in an action for damages for the breach of an express agreement entered) into by appellant to protect appellee fromi assaults and injuries by strikers and strike sympathizers. On July 1, 1922, there occurred a nation-wide strike of shopcráft em-ployés of railway companies including those of appellant at Denison, Tex.
