MEMORANDUM OPINION AND ORDER

GETTLEMAN, District Judge.

Plaintiff, James L. Parker, individually and on behalf of all others similarly situated, filed a class action complaint on May 16, 2001, alleging that defendant, Risk Management Alternatives, Inc., violated the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq. (“FDCPA”).
