This is an action against the defendant for wrongfully moving earth from plaintiff’s premises and digging a ditch thereon for the purpose of constructing a highway over the same. The premises alleged to have been trespassed upon and injured, lie within the corporate limits of the city of Gallatin. The injuries complained of *135were done by the street commissioner of the city of Gallatin, under the verbal direction of the mayor.
