Defendants have moved to dismiss the indictment charging them with criminal sale of a controlled substance in the first degree and lesser included possessory counts, on the ground that they have been denied their right to a speedy trial pursuant to the provision of CPL 30.30. The motion is two-pronged. The first issue was whether dismissal was warranted because the chargeable time exceeded six months.
