James Fitzsimmons and Mary Gibney purchased to*335gether a piece of real estate in the city of Wheeling, under the. following contract: “Wheeling, July 18, 1864. Mr. Fitzsimmons and Mrs. Mary Gibney have this day purchased from Mrs. Mary Anne Fitzpatrick Powell the house and lot northeast corner of Zane and Seventh streets, for the sum of six hundred dollars, and on the following conditions,'to which all parties subscribe: Two hundred dollars to be paid forthwith, and the balance in ■ annual sums of two hundred dollars, with interest at six per cerit.; the deed to be transmitted…
