This is an action of contract. There was a trial by court, and a finding of facts was made. There was a judgment for the plaintiff. The defendant excepted.

While there is no express finding as to several material facts, it appears from the facts found, and which can fairly be inferred from them, that the plaintiff who was a legatee in the estate of Clinton H. Nason employed Wilbur Eno, an attorney, to represent him in the settlement of the estate.
