This is an appeal from a judgment rendered by the court, without the intervention of a jury, adverse to the appellants who were the defendants below.

Appellees herein filed a “Motion to Dismiss or Affirm” for failure of appellants to comply with Rule 2-17 of the Supreme Court, 1964 Edition. Appellants’ brief certainly leaves much to be desired. However, since appellants raise only one issue for our consideration, and it being our desire to decide appeals on their merits wherever possible and we can understand from appellants’ brief the issue he desires to present, we are of the opinion that…
