OPINION
COOCH, Judge.
This is a civil action brought by Theresa Smith (“Claimant”) under Superior Court Civil Rule 71.3 seeking the return to her of one 1985 Mercedes Benz 1 (“Vehicle”). The Vehicle was seized on July 30, 1990 by the New Castle County Police Department in connection with the arrest of Anthony Smith, Claimant’s brother, on various drug related charges. In opposition, the State has filed a petition for forfeiture pursuant to 16 Del.C. § 4784. 2 Claimant having waived her right to a trial by jury, this case was tried before the Court on October 8 and 13, 1992.
