Petitioner alleged that after his automobile became disabled it was pulled to the shoulder on the right-hand side of the two southbound lanes of the parkway, and that at such time his automobile was completely off the two lanes of the southbound arteiy of said parkway; that at approximately 8 p.m., the tow truck was backed up to the rear of petitioner’s automobile for the purpose of taking the automobile in tow, and at that time the operator of the tow truck began to attach petitioner’s automobile to the tow truck; that (Paragraph 7) “while the operator of said tow…
