LATTIMORE, Judge.
In this case appellant was convicted in the Criminal District Court of Travis County for the offense of murder and his punishment fixed at eight years in the penitentiary.
It will be necessary, in order to understand the opinion, to state substantially the facts in the case. Appellant and deceased lived only about two hundred and fifty yards apart, one on the north and the other on the south side of a public road of which deceased was overseer.
