DENISON, Circuit. Judge.

Letta, a resident of Italy, brought suit in the court below against the Cincinnati Iron & Steel Company (hereinafter called the company), seeking to recover commissions earned by him in the sale in Italy of machines made by the company. This petition was upon the theory that there was an express contract to pay him 12% per cent, of the selling price, or, in the alternative, to allow him a discount of 12% per cent, from the stated price, whereby he was entitled to that margin of profit and any excess on a sale by him, or, in the event these theories failed, then that he…
