This is an action in the nature of a suit for money had and received, brought by plaintiff December 7, 1927, in the Circuit Court of St. Louis County. Defendants, appellants, are corporations. The transactions involved herein originated with the trust company. The bank was organized about 1923 by the trust company or its officers and to it the trust company turned over practically all of its assets, including the $13,000 note hereinafter referred to, the bank assuming "certain" of the trust company's liabilities, the liabilities specifically assumed not being more definitely shown.
