The information in this case charges that in Woodward county, February 9, 1924, Walter Gose did “sell one quart of whisky to one Bert Tilford.” On the trial the jury returned a verdict finding the defendant guilty and leaving his punishment to the court. March 12, 1924, he was sentenced to pay a fine of $200 and to be confined in the county jail for 50 days. To reverse the judgment he prosecutes this appeal.
