This appeal is from a judgment against appellant for damages resulting from the failure to transmit and deliver a telegraphic message.

At the time of the transaction disclosed by the record before us, the appellees were the owners of a tract of 160 acres of land situated in the oil territory around Graford, Palo Pinto county, Tex. They allege that on the 19th day of June, 1922, they were offered by the Roxana Petroleum Company $25 per acre for an oil lease of that land.
