The defendant was indicted and convicted for assault with intent to murder and sentenced to four years' imprisonment. At trial and on appeal he is represented by retained counsel.

The State's evidence tends to show that on the evening of October 22, 1978, Robert Bailey was with two friends in the Regal Lounge in Jefferson County. The defendant, who did not know Bailey and whom Bailey did not know, was also present with three of his friends.
