The plaintiffs and the defendant Robert Paine are the heirs at law of James Paine, who died intestate in February, 1875, oyer ninety years of age. On De cember 19, 1867, be conveyed by deed to bis son, the defendant Robei't, and to his grandson, the defendant Garrison, for the recited consideration of four hundred dollars, a tract of land consisting of several associated parts, estimated to contain two hundred and twenty acres, and therein particularly described.
