On June 22, 1910, this case was affirmed. Appellant has filed a motion for rehearing and asks that the affirmance be set aside and that the case be reversed and remanded because the facts in the case show that if there was any embezzlement in this case the same was barred: by the statute of limitation. The indictment in this case was returned against the appellant on the 28th day of October, A. D. 1905.
