Defendant Continental Casualty Company (Continental) appeals from a judgment of the circuit court of Franklin County granting plaintiff Thomas Graman’s motion for summary judgment and denying its motion for summary judgment. On appeal Continental contends that plaintiff was issued a “claims made” policy which required any claim against plaintiff to be made within the period of the policy and be reported to the company no later than 60 days subsequent to the expiration of the policy period.
