OPINION

2Per curiam

On September 29, 1988, Coastal General Construction Services Corporation [“Coastal”] entered into a contract to renovate and modernize the Donoe housing project for the Virgin Islands Housing Authority [“VIHA”] for the negotiated contract price of $2,209,587. Due to Coastal’s inability to secure performance bond and payment bonds, as well as VIHA’s inability to secure adequate federal financing for the project, and before Coastal had begun any work on the project, VIHA issued a notice of termination of the contract on June 6, 1989.
