Appeal by James A. Baker from an order of the Surrogate’s Court of New York county, entered in said Surrogate’s Court on the 8th day of April, 1901, denying his motion to vacate an order for the issuance of a citation directing him to attend and be examined as to any property of the decedent, under section 2707 of the Code of Civil Procedure.

The temporary administrator of the estate of William M. Rice, deceased, presented to the Surrogate’s Court a petition in which he alleged his appointment and qualification as such temporary administrator ; that the deceased died on the 23d day of September, 1900, a resident of the city of New York ; that the petitioner had obtained possession of no books of account of the decedent and only of some of the letters, correspondence, check books and other writings belonging to the said decedent at the time of his death; that in order to obtain accurate information in regard to the…
