ORDER
BROOKS, District Judge.
This matter is before the Court upon the defendant’s motion for summary judgment and this order does not directly address the merits of the plaintiff’s complaint.
This cause of action is brought pursuant to 42 U.S.C. § 1983 and seeks damages stemming from the defendant’s decision not to rehire the plaintiff after the 1975-1976 school year.
