OPINION
CEDARBAUM, District Judge.
Jon Daza brings this action to recover damages for injuries he sustained on May 20, 2010, when a crane block weighing at least a ton tipped over and crushed his left leg. The crane block was located on a barge, the “Uncle Leo,” one of three barges owned by Daza’s employer, Pile Foundation Construction Company, Inc. (“Pile”).
