On the fourth of November, 1887, the appellant, the Mutual Benefit Life Insurance Company, issued a policy of insurance on the life of Hiram H. Harvey for $3,000, payable at his' death to his executors, administrators, or assigns’, in consideration of an annual premium of $107.82, which was to be due and payable on the 4th of November in every year during the continuance of the policy.
