NATURE OF CASE

Merritt G. Brown was convicted by the county court, pursuant to a jury verdict, of motor vehicle homicide in violation of Neb. Rev. Stat. § 28-306(1) (Reissue 1995) for unintentionally causing the death of another person while driving his motor vehicle in violation of Neb. Rev. Stat. § 60-6,148(2) (Reissue 1998) in that Brown had failed to yield the right-of-way to the victim’s vehicle. Brown was sentenced to 12 months’ probation and was fined $500.
