Amos Bobinson was indicted for murder and found guilty, with a recommendation that he be imprisoned in the penitentiary for life. He moved for a new trial, and upon the overruling of the motion filed a bill of exceptions. The headnotes sufficiently deal with the grounds of the motion for a new trial, except that complaining of the charge in regard to dying declarations. Such declarations, made by a person in the article of death, who is conscious of his condition, as to the cause of his death and the person who killed him, are admissible in evidence in a prosecution for the homicide.
