On February 11, 1941, one Harry V. Sherburne executed his last will, Item 5 thereof being as follows:
“I hereby devise, will and bequeath unto Lillian Plumb, now of Brazil, Indiana, the sum of Three Thousand Dollars ($3,000.00).”
Thereafter, in the same year said testator died. After the probate of the said will and the qualification of the executor therein nominated, Terre Haute First National Bank of Terre Haute, Indiana, the appellant, Lillian Plumb demanded of said executor the payment of the legacy less inheritance tax due thereon which payment was refused on the ground that another…
