ROGERS, Justice.

Plaintiff sued the Evans Cooperage Company, Inc., and its liability insurance carrier for damages resulting from the allegedly negligent operation of a truck owned by the defendant cooperage company. Defendants filed a joint answer denying that the truck was negligently operated and pleading in the alternative plaintiff’s contributory negligence as a bar to his recovery. The district court, rendered a judgment awarding plaintiff the full amount of damages claimed by him. The Court of Appeal reversed the judgment and dismissed plaintiff’s suit. Burns v.
