BUSSEY, Presiding Judge.

Joseph DeWayne LaRue, hereinafter referred to as defendant, was charged in the District Court of Oklahoma County with the crime of burglary in the second degree. He was tried by a jury who found him guilty and left the punishment to the court. Motion for new trial was filed on behalf of the defendant and overruled by the court. Judgment and sentence was pronounced against said defendant fixing his punishment at imprisonment in the State Penitentiary for a term of four (4) years, at which time an application for an order of the court suspending said sentence was…
