The opinion of the Court was delivered by

Todd, J.

This is an action brought by the plaintiff, as mother and tutrix of her minor son, for a wound inflicted on him by a minor son of the defendant, by tbe discharge of a gun in the bands of tbe latter, and for the suffering caused thereby.

The defeuse is, that the iujury was the result of an accident, and that the plaintiff’s son contributed thereto by his own carelessness or neglect.

From a judgment upon a verdict awarding one thousand dollars damages, the defendant appeals,
