Plaintiff is a citizen of the state of Montana. The defendant Butte Electric Railway Company is a corporation organized and existing under the laws of the state of West Virginia. Defendant Alfred Jackson is a citizen of Montana. The action was brought in the district court of the second judicial district of the state of Montana, to recover damages alleged to be due by the defendants to the plaintiff for injuries which he charges were done to him by the negligence of the defendants at Butte.
