DAVIDSON, Presiding Judge.
Appellant was convicted of aggravated assault, his punishment being assessed at a fine of $100 and thirty days imprisonment in the county jail.
The assault was charged to have been committed upon Hiss Euby Haynor. The evidence shows that Hr. Ashberry had been seriously hurt, and Hiss Haynor seems to have been a trained nurse, at least, she was nursing him, and had been sitting up a great deal at night.
