*704In an action, inter alia, to recover damages for breach of fiduciary duty, the plaintiff appeals from an order of the Supreme Court, Westchester County (Nastasi, J.), entered March 12, 2003, which granted the motion of the defendants Spear, Leeds & Kellogg, L.P., and Goldman Sachs Group, Inc., pursuant to CFLR 3211 (a) (7) to dismiss the complaint insofar as asserted against them.
Ordered that the order is modified, on the law, by deleting the provision thereof granting that branch of the motion which was to dismiss the fifth cause of action insofar as asserted against the defendant Spear,…
