The subject-matter of this action is a tract of forest land containing two thousand two hundred and fifty acres, constituting the northwest angle of township forty-one, Totten and Crossfield’s purchase, in the county of Herkimer. The action was commenced in December, 1894, and its primary object, doubtless, was to determine whether the title to this land is in the plaintiff or the defendant. The action has taken the form of one in equity, in behalf of the plaintiff to set aside deeds given to the defendant upon a sale of the land for taxes.
