Appellee obtained a verdict and judgment in the Supreme Court of the District in the sum of $10,009 against appellant. (We shall hereafter speak of the parties as plaintiff and defendant.) Her declaration alleges that on the 7th of January, 1929, she was a passenger in an automobile then being driven at a lawful and proper rate of speed along Irving street northeast, in Washington.
