The question presented in this case is the legal right of the Marine Bank & Trust Company, after the People’s Bank had become insolvent and had been taken over for purposes of liquidation by the state bank examiner, to apply a sum on deposit to the credit of the People’s Bank and a surplus collected on bills receivable of the People’s Bank which had been jfiedged to *943the defendant bank for a particular debt, to the payment of a debt due the defendant bank for Liberty bonds which had been placed with the People’s Bank and disposed of for account of the Marine Bank.
