ROSS, Circuit Judge.

The defendant in error recovered judgment in the court below in the aggregate sum of $4,500 as liquidated damages, with interest thereon, on three certain leases of land situated in the state of Texas, in which state the leases were also made, to the plaintiff in error, for the purpose of developing oil and gas thereon, upon certain terms and conditions therein stated, each lease running for 25 years, “and as much longer as oil or gas should be produced in paying quantities,” and including a provision that the lessee should have seven-eighths and the lessor one-eighth of…
