MURRAY, Chief Justice.
This suit was instituted by Southern Brokerage Company in the District Court of Dallas County, 14th Judicial District of Texas, on August 4, 1958, against Republic National Bank of Dallas, First National' Bank in Dallas, Polly Jones, and her husband, Jerry D. Jones. Judgment was rendered by default against Polly and Jerry D. Jones, and they are not parties to this appeal. Upon a motion for summary judgment by Southern Brokerage Company, judgment was rendered in its favor in the sum of $18,699.16 against First National Bank, and in favor of First National Bank over and…
