The plaintiff is bound to make out one or more of the following principles to entitle him to recover in this action.

1st. That the proviso in the Statute of 1807 (Laws relating to City of New York, 434, § 15 [Davies],) under which the Corporation of the City of New York derived title to the lands in controversy, requiring them in case of any conveyance of such lands, to recognize a pre-emptive right in the owners of the adjacent upland,' operated • not merely as a partial 'restraint on alienation by such Corporation, but conferred some new positive indefeasible right…
