Appellant, James Howard Taylor, was indicted for the offense of assault on a family member or a person with whom he had a dating relationship, with a prior conviction for this offense alleged, to elevate the offense to a third-degree felony. 1 The indictment further alleged one prior felony conviction which enhanced punishment to a second-degree felony. 2 Following a trial to a jury, appellant was convicted of the indicted offense.
