OPINION AND ORDER
COFFRIN, District Judge.
On September 7, 1988, defendant Timothy L. Turner brought a motion to suppress material seized during a search of his residence alleging that the search warrant was executed without probable cause. Turner also argued that the warrant was not protected by the good faith exception to the exclusionary rule. The disposition of this motion was referred to United States Magistrate Jerome J. Niedermeier. In an opinion, dated November 9, 1988, Magistrate Niedermeier recommended that the court grant defendant’s motion to suppress. Pending before the court is…
