MAJOR, Circuit Judge.

This action was brought for injunctive relief, alleging conduct by defendants in violation of the Railway Labor Act (45 U.S.C.A. § 151 et seq.), and for damages suffered by plaintiffs as a consequence thereof. On September 29, 1964, United Air Lines, Inc. (United) filed a motion, supported by affidavit and brief, to dismiss the complaint “for lack of jurisdiction and for failure of plaintiffs to state a claim upon which relief could be granted.” Plaintiffs filed a brief and affidavits in opposition thereto.
