In a habeas corpus proceeding, the appeal is from a judgment of the County Cohrt, Dutchess County, dated June 27,1979, which granted the writ and ordered the petitioner’s release from custody. Judgment reversed, on the law, without costs or disbursements, proceeding dismissed and petitioner is directed to surrender himself to the appellants.
