Plaintiff in error, hereinafter called defendant, was convicted in the district court of Nowata county of assault with intent to- kill and was sentenced to serve a term, of one year in the state penitentiary.
At the time charged, defendant, armed with a pistol, went to the residence of his tenant, one Wilson, with whom he had had some prior difficulty. He was in a state of intoxication or partial intoxication and engaged in a quarrel with Wilson and ordered him to leave the premises within thirty days.
