MEMORANDUM OPINION AND FINAL ORDER
EISELE, District Judge.
In its “Memorandum Opinion and Certification Order” of February 4, 2004, this Court moved the Arkansas Supreme Court, pursuant to its recently enacted Ark. Sup.Ct.
