KRUEGER, Judge.
The conviction is for the theft of cattle. The punishment assessed is confinement in the State penitentiary for a term of four years.
Appellant presents two propositions upon which he seeks a reversal. The first is that the evidence is insufficient to justify and sustain the conviction; and the second is that the testimony relative to the conversation between Travis Parrish and Pud Miller in the absence of appellant was not admissible.
